This Notice describes how medical and dental information about you may be used and disclosed and how you can access this information. This Notice applies to all records of your care maintained by Broadview Dental, including records created or maintained by Dr. Sang-Jin Nam, DDS, and members of the Broadview Dental workforce.

Broadview Dental is owned and operated by Dr. Sang-Jin Nam, DDS. Dr. Nam also serves as the practice's Privacy Officer and is responsible for overseeing compliance with applicable federal and state privacy laws, including the Health Insurance Portability and Accountability Act ("HIPAA").

THIS NOTICE DESCRIBES HOW YOUR HEALTH INFORMATION MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Broadview Dental is committed to protecting the privacy and confidentiality of your protected health information ("PHI"). Federal and state laws require healthcare providers to maintain the privacy of patient information and to provide patients with notice of their privacy rights. This Notice explains how Broadview Dental may use and disclose your health information, your rights regarding that information, and our legal responsibilities for protecting it.

Protected health information includes information that identifies you and relates to your past, present, or future physical or dental health condition, the healthcare services you receive, or payment for those services.

We understand that the information you share with us is personal and sensitive. Maintaining your trust is important to us, and we are committed to handling your information responsibly while providing you with quality dental care. We encourage you to review this Notice carefully and contact our office if you have any questions regarding our privacy practices.

Our Legal Duties

Broadview Dental is required by law to maintain the privacy and security of your protected health information, provide you with this Notice of Privacy Practices, and comply with the privacy practices described herein. We are also required to notify you if a breach occurs that may compromise the privacy or security of your information.

We maintain administrative, physical, and technical safeguards designed to protect your information from unauthorized access, use, disclosure, alteration, or destruction. These safeguards include office policies and procedures, employee training, secure electronic systems, password-protected software, restricted access to records, and other measures intended to protect the confidentiality of patient information.

Broadview Dental reserves the right to revise this Notice at any time. Any revisions will apply to all protected health information maintained by the practice, including information created or received before the effective date of the revised Notice.

How We May Use and Disclose Your Health Information

Treatment

Broadview Dental may use and disclose your health information to provide, coordinate, and manage your dental care and related healthcare services. Members of our dental team routinely review medical and dental histories, document clinical findings, develop treatment plans, communicate with patients regarding treatment options, and maintain records necessary to provide appropriate care.

In some situations, treatment may require communication with other healthcare professionals involved in your care. For example, we may consult with physicians regarding medical conditions, obtain medical clearances before treatment, communicate with pharmacies regarding prescribed medications, or refer you to specialists such as oral surgeons, periodontists, orthodontists, endodontists, prosthodontists, or other providers.

To ensure continuity of care and appropriate treatment planning, we may share information such as radiographs, CBCT scans, photographs, digital impressions, treatment plans, chart notes, prescriptions, and other relevant records with healthcare providers involved in your treatment. We may also obtain interpretations of diagnostic imaging from outside radiologists or imaging specialists when necessary.

Payment

Your health information may be used and disclosed to obtain payment for services rendered by Broadview Dental. In order to process claims and receive reimbursement, we may communicate with dental benefit plans, medical insurance carriers, third-party administrators, financing companies, and other entities involved in payment activities.

Payment-related activities may include verifying insurance eligibility, determining benefit coverage, obtaining pre-authorizations and predeterminations, submitting claims, coordinating benefits between insurance carriers, appealing denied claims, and collecting outstanding balances. In some situations, information may be disclosed to billing services, collection agencies, attorneys, or other entities assisting with lawful collection activities.

While we make every effort to help patients understand their insurance benefits, verification of benefits is not a guarantee of payment. Insurance companies make the final determination regarding coverage, eligibility, and reimbursement.

Healthcare Operations

Broadview Dental may use and disclose health information for activities necessary to operate the practice and maintain high standards of patient care. These activities allow us to evaluate the quality of care provided, improve office operations, train staff, maintain professional standards, and comply with legal and regulatory requirements.

Healthcare operations may include quality assessment and improvement activities, staff education and training, credentialing, licensing, accreditation, auditing, compliance reviews, risk management activities, business planning, and other administrative functions necessary to support the operation of the practice.

Information may also be reviewed internally to improve patient experiences, evaluate treatment outcomes, and ensure that our office continues to meet professional standards and patient expectations.

Appointment Reminders and Patient Communications

Broadview Dental may contact you regarding appointments, treatment recommendations, follow-up care, recall visits, insurance matters, billing questions, office closures, and other healthcare-related communications.

Unless you request otherwise, we may communicate with you by telephone, voicemail, text message, email, mail, or other contact methods that you provide to us. Messages may contain limited information necessary to identify our office and communicate the purpose of the contact.

You have the right to request alternative methods of communication or request that we not leave messages at certain phone numbers, email addresses, or mailing addresses. We will make reasonable efforts to accommodate such requests whenever possible.

Individuals Involved in Your Care

There may be situations in which it is appropriate to share relevant information with individuals involved in your care or payment for your care. This may include spouses, parents, legal guardians, adult children, caregivers, or other individuals you have authorized us to communicate with.

For example, we may discuss treatment recommendations, appointment scheduling, insurance benefits, financial arrangements, or post-operative instructions with an individual assisting in your care. If you prefer that we not share information with certain individuals, please notify our office so that your preferences can be documented.

In emergency situations or circumstances where you are unable to communicate your preferences, we may disclose information when we believe it is in your best interest or necessary to prevent serious harm.

Dental Laboratories and Outside Providers

Many dental procedures require collaboration with outside providers and vendors. In order to fabricate restorations, appliances, aligners, dentures, implant components, surgical guides, retainers, and other treatment-related devices, Broadview Dental may share information with dental laboratories, manufacturers, imaging providers, and other entities involved in your treatment.

Information disclosed may include digital scans, impressions, photographs, radiographs, CBCT scans, treatment prescriptions, and other clinical information necessary to complete treatment. Only the information reasonably necessary to perform the requested service will be disclosed.

Business Associates and Technology Providers

Broadview Dental works with a variety of third-party vendors that assist in the operation of the practice. These companies may provide services such as electronic health records, practice management software, cloud storage, cybersecurity support, information technology services, billing services, payment processing, appointment reminder systems, secure communication platforms, and data backup services.

Federal law permits us to share information with these entities when necessary for them to perform services on our behalf. These organizations are required by law and contractual agreement to appropriately safeguard your information and may only use or disclose information as permitted by law.

Electronic Health Records and Technology

Broadview Dental utilizes electronic systems to store, manage, transmit, and protect patient information. These systems may include electronic health records, imaging software, insurance processing platforms, patient communication systems, secure cloud storage providers, and data backup services.

We employ reasonable administrative, physical, and technical safeguards designed to protect patient information from unauthorized access, use, disclosure, alteration, or destruction. Although no electronic system can be guaranteed to be completely secure, Broadview Dental continually evaluates and updates its privacy and security practices in an effort to protect patient information and reduce the risk of unauthorized access.

Patients should be aware that communications transmitted through email, text message, or other electronic means may involve certain security risks despite reasonable safeguards. By providing contact information and authorizing electronic communications, you acknowledge and accept these risks to the extent permitted by law.

Disclosures Required or Permitted by Law

In certain circumstances, Broadview Dental may be required or permitted by law to disclose health information without your authorization.

Examples may include disclosures related to:

• Public health reporting activities
• Reporting abuse, neglect, or domestic violence
• Health oversight investigations and audits
• Compliance with court orders, subpoenas, and legal proceedings
• Law enforcement investigations
• Workers' compensation claims

Any disclosure will be made only as required or permitted by applicable law and only to the extent necessary to comply with legal obligations.

Uses and Disclosures Requiring Your Authorization

Certain uses and disclosures of your health information require your written authorization before Broadview Dental may proceed. Examples include most marketing activities, the sale of protected health information, and certain disclosures not otherwise permitted by law.

You may revoke a previously signed authorization at any time by providing written notice to Broadview Dental. Revocation will apply only to future uses and disclosures and will not affect information already disclosed or actions already taken in reliance upon a valid authorization before the revocation was received.

Your Rights Regarding Your Health Information

You have important rights regarding your protected health information. These rights include:

• The right to inspect and obtain copies of your health records.
• The right to receive records in electronic format when available.
• The right to request corrections or amendments to information you believe is inaccurate or incomplete.
• The right to request confidential communications.
• The right to request restrictions on certain uses and disclosures.
• The right to receive an accounting of certain disclosures.
• The right to obtain a paper copy of this Notice at any time.
• The right to designate a personal representative to act on your behalf when legally authorized.
• The right to file a complaint regarding our privacy practices.

Requests to access, amend, restrict, or otherwise exercise your privacy rights should generally be submitted in writing. Reasonable fees permitted by law may apply to copies of records.

Personal Representatives, Guardians, and Minors

Individuals who have legal authority to act on behalf of a patient may exercise certain privacy rights on that patient's behalf. This may include parents of minor children, court-appointed guardians, executors of estates, or individuals holding a valid healthcare power of attorney.

Before releasing information or granting access to records, Broadview Dental may require documentation establishing the individual's legal authority to act on behalf of the patient.

Breach Notification

If a breach involving unsecured protected health information occurs, Broadview Dental will provide notification to affected individuals and governmental agencies as required by applicable federal and state law.

Complaints

If you believe your privacy rights have been violated, you have the right to file a complaint with Broadview Dental or with the U.S. Department of Health and Human Services, Office for Civil Rights.

You will not be denied treatment, penalized, retaliated against, or otherwise treated differently for filing a complaint.
